              <p>Drive Web Marketing Agency Inc.'s hosting fees include licensing fees for the Drive CMS. Should a client decide to change hosting companies, the Drive CMS will no longer be available to them.</p>

              <p>Drive Web Marketing Agency Inc. supplies email hosting and support as part of a packaged service to our customers. If, for whatever reason, our servers are down for maintenance or unforeseen circumstances, Drive Web Marketing Agency Inc. is only responsible for getting service restored and cannot be held liable for any other loss of business due to down time.</p>
              <p>Drive Web Marketing Agency Inc. is also not responsible for lost email due to unforeseen circumstances and cannot dictate the spam filter rules or routing rules of third party servers.</p>
              <p>In no circumstances, to the fullest extent permitted at law, shall Drive Web Marketing Agency Inc. nor or any of its officers or employees be liable for any loss, additional costs or damage howsoever arising suffered as a result of any email down time or configuration settings on servers outside of our control.
              <p>Drive Web Marketing Agency Inc.'s email service provides customers with the capability to send and receive email via the Internet. Drive Web Marketing Agency Inc. retains the right, at our sole discretion, to restrict the volume of messages transmitted or received by you in order to maintain the quality of our email services to other Members and to protect our computer systems.</p>
              <p>As an owner and operator of the equipment and other resources utilized to provide services, Drive Web Marketing Agency Inc. has the legal right to block electronic communications from other entities on the Internet.</p>

              <h2>REFUNDS</h2>
              <p>All Website design and programing sales are final. In most cases, design mockups are created and approved before a deposit is requested. When a client approves a mockup or verbally agrees to a commitment, the deposit is made and the project details are listed on the customer's control panel so that both parties are clear of all requirements before proceeding. A contract may be negotiated before signing but must be adhered to once a signed agreement is complete. If you agree to mock ups but fail to follow through on a contract and/or deposit, we retain the right to bill you for time taken to create the mockups at our regular hourly rate of $120. Drive Web Marketing Agency Inc. also reserves the right to retain the initial deposit to cover cost of work.</p>
              <p>Drive Web Marketing Agency Inc. may accept a refund request in some cases, at our discretion. An Instance where we would accept a request for a refund would be if Drive Web Marketing Agency Inc. and client are unable to work together in a communicative and professional manner or if creative differences force an end to all work. If this is the case it will always be if the amount of hours put towards the job is less than the total amount of the deposit paid for the job. If this is the case, the remaining monies left after billing for all hours to date can be refunded to the client within 14 days and all work will cease.</p>

              <h2>RETURN POLICY FOR OTHER SERVICES</h2>
              <p>Other services including, but not limited to Graphic Design, Web Design and Development are typically custom projects. Each project is evaluated individually to estimate the total project cost, based upon the unique needs of each client.</p>
              <p>Drive Web Marketing Agency Inc. maintains the same refund requests for all other hourly work as stated in the above Design and Programing Policy.</p>

              <h2>RETURN POLICY FOR HOSTING SERVICES</h2>
              <p>All hosting sales are guaranteed 95% uptime and 100% client satisfaction. If a refund is requested, Drive Web Marketing Agency Inc. will refund a prorated amount, which is the total amount paid minus any time used in the contract. Our hosting rates include our software licensing fee. If a client wishes to change hosting companies, they will no longer have access to the Drive CMS.</p>
              <p>If a refund request is accepted, any monies left after the prorated charges will be returned to the client and all hosting will immediately cease upon payment of refund, which is usually 7 to 14 days from the request.</p>
            </section>

              <h2>DRIVE CMS</h2>
              <p>The Drive CMS is a proprietary framework created for Drive Web Marketing Agency Inc. specifically designed to serve the needs of our clients. The framework is a closed-source project developed in-house.</p>
              <p>Unauthorized use of Drive CMS will result in immediate termination of the client's site. Any attempts to reverse engineer proprietary technology will result in legal action.</p>
